END USER LICENSE AGREEMENT (EULA) FOR SIMPLE PILLS APP
IMPORTANT - PLEASE READ CAREFULLY: THIS END USER LICENSE AGREEMENT ("EULA") IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL OR A SINGLE ENTITY) AND ØYSTEIN MØRKESDAL ("DEVELOPER") FOR THE SIMPLE PILLS APP (THE "SOFTWARE"). BY DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE.
LICENSE GRANT: Developer grants you a non-exclusive, non-transferable, revocable license to use the Software for your personal, non-commercial use only.
RESTRICTIONS: You may not sell, rent, lease, sublicense, distribute, assign, or otherwise transfer any rights in the Software. You may not copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software, except to the extent that such activity is expressly permitted by applicable law.
OWNERSHIP: The Software is owned by Developer and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Developer retains all right, title, and interest in and to the Software, including all intellectual property rights.
DISCLAIMER OF WARRANTIES: THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.
LIMITATION OF LIABILITY: IN NO EVENT SHALL DEVELOPER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TERMINATION: This EULA will terminate immediately upon your breach of any term of this EULA. Upon termination, you must immediately cease all use of the Software and destroy all copies of the Software in your possession.
GOVERNING LAW: This EULA shall be governed by and construed in accordance with the laws of Norway, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising under this EULA shall be brought exclusively in the courts located in Norway, and the parties hereby consent to the personal jurisdiction and venue of such courts.
ENTIRE AGREEMENT: This EULA constitutes the entire agreement between you and Developer with respect to the Software and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Developer.
ACKNOWLEDGEMENT: By downloading, installing, or using the Software, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
